Terms of Service

These Terms of Service ("Terms") govern your use of the Monumize website at monumize.com and the Monumize app (together, the "Service"). By creating an account or using the Service, you agree to these Terms. "Monumize", "we" and "us" mean the business that operates the Service, whose contact details are in section 18. Monumize accounts are for businesses (monument shops and their staff), not for personal or household use.

1. Who can use Monumize

The Service is intended for business use by monument shops and similar professionals. You must be at least 18 and able to form a binding contract. If you use the Service for a business, you confirm that you have authority to accept these Terms for it.

2. What Monumize does

Monumize is software for monument shops. You upload a photo of an existing stone and enter its size; Monumize straightens the photo, reads the engraved dates, suggests the closest lettering style from its font catalog, and generates cut files (DXF, EPS, PLT, PDF, SVG) and a placement sheet for new lettering.

Monumize does not cut, engrave, install or sell memorials, and is not a party to any agreement between you and your customer, a family or a cemetery.

3. Your account

Sign-in uses one-time links sent to your email address. Keep access to that email account secure; you are responsible for activity under your account. Tell us promptly at info@monumize.com if you believe your account has been misused.

4. Acceptable use

You agree not to:

• use the Service for anything unlawful, or to create lettering that is defamatory, harassing or infringes someone else's rights;
• upload photos or text you don't have the right to use;
• scrape, copy or resell the Service or its output as a competing service, or access it by automated means other than normal use;
• probe, disrupt or bypass the Service's security or rate limits.

We may suspend or close accounts that break these rules.

5. Fees and payment

Each job costs US $49, plus any sales tax calculated at checkout. A job is one stone and one new line of lettering. You pay once, when you first unlock the cut files for that job; generating the files again for the same job (for example, to fix a typo or adjust spacing) is free.

Payment is processed by Stripe on a Stripe-hosted checkout page; Monumize does not see or store card numbers. Stripe emails a receipt and invoice. Charges appear on your card statement under the name shown at checkout. Prices may change for jobs started after a change is posted.

First job free. Each shop's first job is free: you can unlock its cut files without paying. It is one free job per shop, not per account; opening extra accounts to get more free jobs isn't allowed, and we may close accounts or charge for jobs unlocked that way.

Free job credits. Free job credits (for example from the referral program below) each unlock one job's cut files. They have no cash value, can't be transferred, sold or exchanged for money, and end if your account is closed. A credit used on a job that is later paid for is returned to your account.

Discount codes. Promotion codes entered at checkout apply only as described when they are issued, can't be combined unless we say so, and may be withdrawn or expire.

5A. Referral program

You can share your personal referral link with other monument shops. When a shop that hasn't used Monumize before signs up through your link, it gets one extra free job, and when it completes its first paid job, you get one free job credit. Referrals between accounts of the same business, self-referrals, and referrals obtained by spam or by misleading people don't count, and we may withhold or remove credits earned that way. Send your link only to people who would expect to hear from you. We may change or end the referral program at any time; credits already earned stay usable while your account is open.

6. Refunds

If a cut file is unusable because of a defect in Monumize's output, email info@monumize.com within 30 days of payment and we will fix the file or refund the job fee. If we refund a job in full, access to that job's files ends.

We don't refund for errors in information you entered (sizes, corners, dates, spelling) or after the lettering has been cut. Card disputes follow Stripe's process. Nothing in this section limits rights you have under applicable law.

7. Check before you cut

Date reading, font matching, measurements and placement are automated and can be wrong. Before cutting, you are responsible for checking the text, spelling, dates, font, size and placement against the actual stone, for example by printing the 1:1 PDF and holding it against the stone. Monumize is not responsible for the cost of stone, labor, re-cutting or replacement caused by a file you did not check.

8. Your content

You keep ownership of the photos and text you upload ("Your Content"). You give Monumize a limited license to store and process Your Content only to provide the Service to you: to straighten and read the photo, match the lettering (which includes sending an image crop of the lettering to our AI provider), generate files and support your account.

You are responsible for having any permission needed from the family, cemetery or photographer to upload Your Content.

8A. Sharing proofs with families

You can create a private link to a job's proof (the stone photo with the new lettering, the new text and its size) to send to the family. Anyone who has the link can view that proof until the link expires (60 days) or you turn it off, and can send you a reply ("Looks right" or "Request a change"). Share the link only with people who are allowed to see that stone and inscription. A family's reply on a proof doesn't replace your own check before cutting (section 7). We may disable a link that is misused.

9. Fonts and cut files

Cut files contain lettering outlines made with open-licensed fonts (SIL Open Font License 1.1); see the font credits on the Legal page. You may use the files you download for your own customers' memorials.

Monumize's software, website content and brand belong to Monumize. Product and font names mentioned on the site are trademarks of their respective owners; Monumize is not affiliated with them.

10. Service availability

We work to keep the Service available, but it may be interrupted for maintenance, updates or reasons outside our control. We may change or discontinue features. If we discontinue the Service, you will be able to download the files for jobs you have paid for before it closes.

11. Disclaimer

Except as stated in these Terms, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows.

12. Limitation of liability

To the fullest extent the law allows, Monumize is not liable for indirect, incidental, special or consequential damages, including the cost of stone, labor, re-cutting or replacement, or lost profits. Our total liability for any claim relating to the Service is limited to the fees you paid for the job the claim relates to.

12A. Indemnity

You will defend and indemnify Monumize against third-party claims arising from Your Content, from lettering you cut using files from the Service, or from your breach of these Terms, except to the extent the claim is caused by Monumize's own breach of these Terms.

13. Ending your account

You can stop using the Service at any time and ask us to delete your account at info@monumize.com. We may suspend or close accounts that break these Terms. Sections 6, 7, 8, 11, 12, 12A, 14 and 17 survive.

14. Governing law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Kentucky, and you consent to their jurisdiction.

15. Changes

We may update these Terms. We will post the new version here with a new effective date and, for material changes, email active users before the change takes effect.

16. Emails and notices

We send emails about your account and jobs (sign-in links and codes, receipts, and replies to family proofs) as part of the Service. We also send a few emails to help you get started; each has an unsubscribe link and unsubscribing doesn't affect your account. You agree that we may give you notices about these Terms by email or on the site, and that electronic notices and records satisfy any requirement that they be in writing.

17. General

These Terms, together with any written agreement you sign with us (for example a dealer agreement), are the whole agreement between you and Monumize about the Service. If part of these Terms can't be enforced, the rest stays in effect. Not enforcing a provision isn't a waiver of it. You may not transfer your account or these Terms without our consent; we may transfer them as part of a sale or reorganization of the business. We aren't liable for delays or failures caused by events outside our reasonable control.
